CHAP. 105.

that nothing in this act shall be so construed as to de-
prive such clerks and registers from collecting said fees,
by warrant, suit or otherwise.

sheriff to be
collected be-
fore 1st of
May, 1853.

SEC .2. And be it enacted, That all fees due such clerks
and registers, shall be placed in the hands of the sheriffs
of the several counties of this State, and of the city of Bal-
timore, wherein the debtor or debtors may reside, on or
before the first day of September, eighteen hundred and
fifty-two; and that such sheriffs shall collect the same on
or before the first day of May, eighteen hundred and
fifty three, and shall account with such clerks and re-
gisters for said fees; and on failure to collect and ac-
count with such clerks and registers on such day, the

official bonds of such sheriffs shall be liable to be put
in suit, at the instance and for the use of every per-
son or persons aggrieved thereby.

Act, how con-
strued.

SEC. 3. And be it enacted That nothing in this act
contained shall be construed to make any sheriff an-
swerable for the failure to collect any fees, unless the
same, by the use of due diligence, could have been
collected.

SEC. 4. And be it enacted, That this act shall take
effect and be in lull force from and after its passage.

CHAPTER 105.

AN ACT for the relief of Thomas P. Chiffelle and
Alexander J. Bouldin of the City of Baltimore.

Compensation
allowed.

SECTION 1. Be it enacted by the General Assembly

of Maryland, That the Treasurer be, and he is hereby
authorised and directed, to pay on the warrant of the
Comptroller, to Thomas P. Chiffelle and Alexander J.
Bouldin, each the sum of seventy-five dollars, as com-
pensation for surveying, inspecting and reporting to
the House of Delegates, of December session eighteen
hundred and forty-nine, the state and condition of the
Baltimore and Susquehanna rail road, in pursuance of
an order passed the twenty-eight of February, eighteen
hundred and fifty.

In force.

SEC. 2. And be it enacted, That this act shall take
effect from the date of its passage.
