are, or shall be, by law, authorised to charge and re-
ceive.

CHAP. 93.

SEC. 7. And be it further enacted, That any rail
road that may hereafter be constructed or purchased by
the said Cumberland Coal and Iron company, shall be
so located or used as to occupy as little space at the
passage through the Gap at Wills' Mountain, near
Cumberland, as may be compatible with the full and
convenient use of such mil road, and in such manner
as to produce as little obstruction as may be to the loca-
tion of other rail roads through said gap, by any com-
pany now authorised, or that may hereafter be authoris-
ed, to construct the same under the authority of this
State.

SEC. 8. And be it further enacted, That all ques-
tions of difference that may hereafter arise, between the
said Cumberland Coal and Iron company, and any
other company or citizens, in regard to the locating,
constructing or working its rail road or rail roads, or in
respect, to the charges for transportation thereon, as
authorised by this act, shall be submitted to, and be de-
cided by the Commissioners of Public Works of this
State, and in case of an equal division of the Board of
Commissioners, the Treasurer of the State shall decide
the same, and the decision of said Board or Treasurer
shall be final.

SEC. 9. And he it enacted, That so soon as this
act shall be accepted by the said Cumberland Coal
and Iron company, the same shall take effect, and be
held and considered as a part of the charter of said
company; Provided, however, that the right is reserved
to the General Assembly to alter, amend or repeal this
act, or any of the provisions thereof, at pleasure.

SEC. 10. And be it further enacted, That the said
Cumberland Coal and Iron company shall be, and
they are hereby requited annually to mine out and
carry to the Atlantic market, commencing within six
months after said Cumberland Coal and Iron company
shall accept the provisions of this act, at least two
hundred thousand tons of coal, and a failure to mine
out and convey to market the quantity of coal as afore-
said, shall be a forfeiture of all the corporate lights,
privileges and franchises, granted to, or conferred on
the said Cumberland Coal and Iron company, under
this act.

nually, on the first day of January, in each and every
