1852.

SEC. 10. And be it enacted, That the said com-
pany shall be, and is hereby clothed and invested as
respects the said road, with all and singular, the lights,

privileges, immunities and advantages, not inconsistent
with the provisions of this act, that are held, used and
possessed by the several turnpike companies in this
State, and shall be governed by the same regulations,
and be subject to the same fines, penalties and restric-
tions, as the said companies now are, where the same
are not inconsistent with the provisions of this act.

CHAP. 237.

Rights and
privileges.

SEC. 11. And be it enacted, That when the said
road has been completed according to the provisions of
this act, it shall and may be lawful for the company to
erect one gate on said road, provided the same is as
nearly equi distant from the termini as practicable, and to
appoint such toll gatherers as they shall think proper, who
are hereby authorised and empowered to collect and re-
ceive of, and from, all and every person and persons
using the said road, the tolls and rates hereinafter men-
tioned, and to stop any person riding, leading or driv-
ing any horses, cattle, hogs, sheep, sulkey, chair,
chaise, cart, waggon, sleigh, sled, or any other carriage,
either of pleasure or burthen, from passing through
said gate, until they have respectively paid the same,
that is to say the following sums of money, and so in
proportion for any greater or lesser number of sheep,

Tollgate to be
erected.

nogs, cattle, to wit: for every score of sheep or hogs,

five cents; for every score of cattle, eight cents; for
every horse and his rider, or lend horse, two cents; for
every chair or chaise, with one horse and two wheels,
three cents; for every chariot, coach stage, waggon,
phaeton, or chaise, with two horses and four wheels,
six cents; for either of the carriages last mentioned,
with four horses, eight cents; for every other carriage

of pleasure, under whatsoever name it may be known,
the like sums according to the number of wheels and
horses drawing the same; for every cart whose wheels
do not exceed the breadth of two and one-half inches,
or less, with one horse, four cents, and one cent for
every additional horse drawing the same; for every
cart, the breadth of whose wheels shall be three and
one half inches or more, with one horse, three cents,
and one cent for every additional horse drawing the
same; for every waggon of burthen, whose wheels
shall be three inches or less, with one horse, five cents,
and one cent for every additional horse drawing the
same; for every waggon of burthen, whose wheels are
three and one half inches or more, three cents, and one
