CHAP. 173.
|
|

SEC. 4. And be it enacted, That the Clerks of the
Superior Court and Clerks of the Circuit Court (who
shall be entitled to a fee of ten cents for administering the
aforesaid oath) shall report to the Secretary of State,
at least once a month, the names and offices of all
officers who have taken and subscribed the same before
them, respectively, which reports shall be carefully
preserved by him; and he shall be competent to certify
the character and qualifications of officers equally with
the aforesaid clerks.

SEC. 5. And be it enacted, That any person, whe-
ther elected or appointed to office, who shall decline
or neglect to take and subscribe the oaths or affirma-
tions for the period of thirty days, after the re-
turns of elections, or notifications of appointments,
shall be made or left in the offices of the aforesaid
clerks, shall be deemed to have refused acceptance of
such office.

SEC. 6. And be it enacted, That nothing in this
act contained, shall be construed to apply to members
of the General Assembly, or to corporation officers, or
to those employed under either.

SEC. 7. And be it enacted, That the oath or affir-
mation required to be taken and subscribed by the
members of the General Assembly, shall be adminis-
tered by a member of the Senate to the President, who
shall administer the same to the other members of that
body, and to its officers, and the same shall be sub-
scribed accordingly, and be administered by one of the
members of the House of Delegates to the Speaker,
and by him to the other members of that body, and to
its officers, and the same shall be subscribed accord-
ingly.
