LAWS OF MARYLAND.

1811.

persons interested are either dead or removed to the
western country, and that the petitioners aforesaid
are the only persons interested; and have prayed that
a law may pass empowering Joseph Greenawalt and
Emanuel Brower to sell and convey such part of the
four acres as may be necessary for them to erect a
suitable building for a school, and a place of public
worship: — Therefore,

public worship.

BE IT ENACTED by the General Assembly of
Maryland, That the said Joseph Greenawalt and
Emanuel Brower, or the survivor of them, be, and
they are hereby authorised and empowered to sell
and dispose of such part of the four acres of land, as
they may deem necessary for the purpose of erecting
a school-house, which house, when so erected, may
also be used as a place of public worship.

They shall con-
vey said pro-
perty to purcha-
sers under a cer-
tain provision.

AND BE IT ENACTED, That the said Greena-
walt and Brower, or the survivor of them, on receipt
of the purchase money, shall, by a good and sufficient
deed, duly executed and acknowledged according to
law, grant, bargain and sell, make over and convey
to the purchaser or purchasers thereof, and his, her or
their heirs and assigns forever, all the right, title, in-
terest and estate of those persons who purchased the
aforesaid four acres of land, in the year one thousand
seven hundred and sixty eight; Provided nevertheless,
That the said Greenawalt and Brower, before they
proceed to said sale, shall give bond, payable to the
state of Maryland, with two sureties to be approved
of by the judges of Frederick county court, condition-
ed for the faithful performance of the trust in them
rested by this act, which bond shall be lodged with
the clerk of said county, to be by him recorded among
the land records of said county, and the same, or an
office copy thereof, shall be subject to be put in suit
by any person or persons interested therein.

Appointment
of teachers, &c.

AND BE IT ENACTED, That Joseph Greena-
walt, Jacob Apler, John Greenawalt, John Nichode-
mus and Henry Baker, senior, be, and they are here-
by appointed trustees of the said school, with power
to fill up any vacancies that may happen by death, re-
signation or refusal to act, of any one or more of the
members thereof; and that the said trustees and their
successors, or a majority of them, shall., from time to
time, and at all times hereafter, appoint such teachers }
for instructing the scholars in said school, and to
make such arrangements and regulations as they may
conceive necessary for the good government of said
school, and the instruction of the scholars aforesaid
