49. AND BE IT ENACTED. That if any auc-
tioneer, constable or other person shall sell any arms or
accoutrements where there is reason to believe they are
the property of the state; such person shall, for every gun
or the accoutrements of a militia man thus sold, forfeit
the sum of ten dollars, to be recovered by any commis-
sioned officer under this act, in the same manner that
other fines and forfeitures are directed to be recovered un-
der this act.

50. AND BE IT ENACTED, that the several
commanding officers of companies in whose district a
uniform company may be formed agreeably to the provi-
sions of this act, and where a number of persons belong-
ing to said district shall not wish to uniform themselves,
such commanding officers shall hereby be authorised to
drill or cause to be drilled said persons, separate from his

51. AND BE IT ENACTED, That out of the mi-
litia enroled as is in this act directed, there shall be form-
ed for each battalion, at least one company of grenadiers,
riflemen or light infantry; and that to each brigade
there shall be at least one company of artillery, each of
the non-commissioned officers and privates or matrosses
of which shall, within twelve months after their enroll-
ment, in such company, provide himself with a sword or
hanger, under the penalty of a sum not exceeding ten
dollars, nor less than five dollars, at the discretion of a
company court martial; and a further sum not exceeding
ten dollars nor less than five dollars for every year he shall
remain unprovided as aforesaid; and that to each brigade
there shall be attached at least four troops of horse; each
of the dragoons whereof, shall, within twelve months
after, his being enroled therein, arm and equip himself
in the manner prescribed by the act of congress, under
the penalty not exceeding twenty dollars, nor less than
five dollars; and a further sum not exceeding twenty dol-
lars nor less than five dollars at the discretion of a company
court-martial, for every year he shall delay his armament
and equipment as aforesaid; and every citizen so enroled,
armed and equiped shall hold bis arms, ammunition, ac-
coutrements and horse free and exempt from all suits, dis-
tresses, executions or sales for debt, rent or the payment of
