the said street and docks, and of the damages sus-
tained in consequence of such extension and filling
up, which shall have been ascertained according to
the provisions of this act.

1812.

10. AND BE IT ENACTED, That if, in the opinion
of the said commissioners or a majority of them, it shall
be deemed advisable to sell and dispose of the right of
extending and filling into the basin, said wharf or slip,
of the dimensions herein before set forth, and the lots
and streets thus to be made, erected and filled in, be-
fore the same shall have been completed; that in such
case the said commissioners, or a majority of them,
shall be, and they are hereby authorised to sell and
dispose of the same, in the same manner, and on the
same terms and conditions as is herein before directed,
in case the said wharf had been made and completed;
-and shall have the same power to convey to such pur-
chaser or purchasers, and to receive and pay over the
sum or sums of money for which the said right
and lots may sell, as is provided in the preceding
section

11. AND BE IT ENACTED, That all the wharves
which may be constructed on the south side of Pratt
street, and on the said slip extended, shall at all times
hereafter be taken and considered as public wharves,
and free to all the citizens of the state of Maryland,
without any charge of wharfage; but subject in all
other respects to the controul of the harbor-master as
other public wharves are, with the exception of the
wharves in front of the lots to be hereafter sold on the
said slip, which are hereby declared to be the private
property, and of right to belong to the purchaser or pur-
chasers of the lots on the said slip or wharf, to the ex-
tent in each instance of the width of such lots.

12. AND BE IT EN ACTED, That if the lots on
said block or wharf be sold before said wharf be built
out, so that the purchasers shall be at the expense of
building the same, then one half of the money which
shall be raised by the sale thereof, shall be applied to
deepening the basin and entrance thereto of the city of
Baltimore, and for that purpose shall be paid to the
corporation of said city; and if said commissioners
shall build out said wharf before selling the same,
then there shall be deducted from the amount of money
which shall be paid for said lots, the expense of building
out said wharf, and all other expenses appertaining to
it; and one half of the balance after said deduction,
shall be applied and paid as aforesaid; but the whole
of the money arising from the sale of said lots shall
