LAWS OF MARYLAND.

CHAP. 414.

Mary's county, be and they are hereby authorised
and empowered, at any time within two years from the
passage of this act, to enquire and determine wheth-
er the public convenience will be promoted by mak-
ing public the road leading from the Horse landing,
on the Patuxent river, through the lands of George
Thomas, till it intersects the public road leading from
Saint Joseph's Church to the Persimmon End-bridge,
in said county, and also to enquire whether the public
convenience will be promoted by the construction
of a public landing, at Horse landing, upon the lands
of George Thomas, in said county, and further to de-
termine the quantity of land necessary to condemn
for that purpose.

Commissioners
to be appointed.

SEC. 2. And be it enacted, That should the said
commissioners of tax decide that the public con-
venience will be so promoted, they are hereby autho-
ised and required to appoint three commissioners,
citizens and landholders of Saint Mary's county, who,
or a majority of them, shall have power and authori-
ty to meet on the said land, and ascertain and deter-
mine the amount of damages which the proprietor of
the land condemned shall be entitled to receive, and
in doing so the said commissioners shall take into
consideration the present value as a private road and
landing of the said road and landing to the proprietor,
and every other circumstance which may affect the
value of said road and landing, and also the damages
to the proprietor consequent upon the condemnation
thereof, and shall certify and return to the said com-
missioners of lax, under their hands and seals, their
valuation of the said land condemned for said road
and landing and damages consequent upon said con-
demnation, and shall cause a plat thereof to be made
by any competent surveyor, to be by them appointed,
and the same when returned by said commission-
ers, shall be filed and preserved among the land re-
cords of the said county.

Right of appeal.

SEC. 3. And be it enacted, That if the said pro-
prietor feels himself aggrieved by the damages asses-
sed by the said commissioners in their return, he
shall have the right of appeal to the next term of
Saint Mary's county court, after such return.

Return, etc.,
made binding.

SEC. 4. And be it enacted, That said return and
damages assessed, if no appeal be taken, or if any ap-
peal be taken, upon the confirmation thereof by the
county court, as the case may be, shall be binding
on the said county and the proprietor of the said
land.
