SEC. 5. And be it enacted, That after the provisions
of this act shall have been complied with, the road
mentioned in this act shall be a public highway, and
the commissioners of tax of Saint Mary's county, are
hereby authorised and required to cause the same to be
kept in repair as other county roads are now provided
by law.

How kept in
repairs.

SEC. 6. And be it enacted, That it shall be the duty
of said commissioners of tax, at the annual levy after
the said return, or after its confirmation by the county
court, as the case may be, to cause a sum of money to
be levied upon the assessable property of Saint Mary's
county, loan amount equal to the sum which shall have
been ascertained as aforesaid, for the use and benefit of
the proprietor of the said land condemned as aforesaid,
which shall be collected and paid over to him, or to his
heirs or representatives, and that upon the payment of
said money, and not before, the land so condemned
shall be taken and deemed a public landing and public
road, and used and enjoyed as such.

SEC. 7. And be it enacted, That it shall not be law-
ful for the said commissioners of tax to use, or to au-
thorise to be used, the said land so condemned for a
public landing, for any other purpose than that men-
tioned in the preceding sections, or for the construction
of warehouses thereon, for the use of the public.

SEC. 8. And be it enacted, That the said commis-
sioners, before they proceed to act, take an oath, truly
and faithfully to discharge the trust confided to them by
this act.

SEC. 9. And be it enacted, That the said commis-
sioners of tax, shall also at the same time make a levy
for the payment of all the expenses attending the exe-
cution of this act, including the surveyor's fees, and two
dollars a day to each of the commissioners.
