CHAP. 404.

Assessment of
damages.

SEC. 4. And be it further enacted, That it shall be the
duly of said road commissioners, to estimate the dam-
nges accruing to each individual, in consequence of said
road passing through his lands or premieres, and to make
a return of the same, taking into consideration also the
advantages derived from said road, and also to estimate
and make a proper return of the sums of money neces-
sary to open and grade the same.

Compensation.

SEC. 5. And be it further enacted, That the said
road commissioners, while actually engaged in laying
out said road, and making a return of the same, shall
receive not exceeding two dollars a day, and the engi-
neer not exceeding four dollars a day, and the other
hands, necessary to be employed, not exceeding one
dollar a day each, and two-thirds of the whole expense
of laying out said road, shall be paid by the commis-
sioners of Frederick county, and one-third of the same,
by the commissioners of Washington county.

CHAPTER 404.

An act to Authorise the opening of a new road in Saint
Mary's County.

Commissioners
to be appointed.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the commissioners of tax of Saint
Mary's county, be and they are hereby empowered to
appoint three commissioners, who shall have power to
enter upon, survey, lay off and locale a public road,
from the present main road, leading by the Trappe, in
Saint Mary's county, to some suitable point on Canoe
Neck creek.

May condemn
land.

SEC. 2. Be it enacted, That the said commis-
sioners so appointed, or a majority of them, shall have
power to value and condemn the land or lands over
which they may locate said road, and cause the same to
be surveyed, and a plat thereof, and the valuation and
condemnation of the lands as aforesaid, together with
the expenses attending the execution of this act, shall
be returned, in a report, to the commissioners of tax of
Saint Mary's county.

Right of appeal.

SEC. 3. Be it enacted, That any patty interested, as
well as the county authorities, make lake an appeal to
the next county court, after the return of the report of
said commissioners.
