CHAPTER 403.

CHAP. 403.

An act to authorise the Levy Court of Frederick coun-
ty, in their discretion , to appoint Two Road Com-
missioners, and the Commissioners of Washington
County, in their discretion, to appoint One Road
Commissioner, to be constituted a Board to lay out
a Road from the town of Frederick to Smithsburg,
in Washington county.

SECTION 1. Be it enacted by the General, Assembly
of Maryland, That as soon as may be, after the passage
of this act, it shall be the duty of the levy court of Fred-
erick county, in their discretion, to appoint two road
commissioners, and the duty of the county commission-
ers of Washington county, in their discretion, to appoint
one road commissioner, who together shall constitute a
board for laying out a road from the city of Frederick to
the town of Smithsburg, in Washington county.

SEC. 2. And be it further enacted, That the said
road commissioners, after having taken the oath in such
cases provided, and having procured the services of a
competent engineer, and his assistants, and having given
due notice, in one newspaper printed in the city of Fre-
derick, and one printed in Hagers city, at least three
successive weeks, of the time and place of beginning,
shall proceed to lay out the said road, not exceeding
forty feet in width, by the most direct and practicable
route between the North end of the said city of Frede-
rick, Hamburg, and the town of Smithsburg, in Wash-
ington county, using therefore the beds of such county
roads as may he suitable, and deviating therefrom when
necessary, so that the grade of said road shall in no
place exceed five degrees from a horizontal line.

SEC. 3. And be it further enacted, That after the lay-
ing out of the said road shall have been completed, and a
proper return of the part thereof lying in Frederick county,

shall have been made to the clerk of said county, and a
return of the part lying in Washington county, shall
have been made to the clerk of that county, that it shall
be die duty of the county commissioners of said two
counties respectively, to appoint supervisors, and assess,
such sums of money as may be necessary to open and
grade the parts of said road lying in their respective
counties, and it shall also be the duly of said commis-
sioners and levy court, annually thereafter, to assess
such sums of money, on their respective counties, as
may be necessary to keep said road in good repair.
