A further supplement to the act to regulate Sales by
Public Auction, passed at December Session, eigh-
teen hundred and twenty-seven, chapter one hundred
and eleven.

Preamble.
|
WHEREAS, numerous persons are engaged in selling
goods, wares and merchandise, within the limits of the
town of Cumberland, in Allegany county, without a li-
cense, as required by the act passed at December session,
in the year of our Lord eighteen hundred and forty-
three, chapter one hundred and seventy-four, under pre-
tence that such goods, wares and merchandise are not
brought from abroad to sell at auction Within the limits
aforesaid, by them, and that such goods, wares and
merchandise, are not sent from abroad for the express
purpose of selling upon commission, whereby the reve-
nues of the State are greatly diminished; and whereas,
the regular auctioneers, who have paid the license re-
quired by the said act, are seriously injured in their bu-
siness, by the unlawful interference of the persons afore-
said — Therefore,

SECTION 1. Be it enacted by the General Assembly
of Maryland, That from and after the passage of this
act, it shall not be lawful for any person to sell at auc-
tion or public vendue, any goods, wares or merchandise
within the limits prescribed by the aforesaid act, passed
at December session, in the year of our Lord eighteen
hundred and forty-three, chapter one hundred and sev-
enty-four, unless such person shall first procure a license
in the manner provided by the said act, and any person
violating the provisions of this act, shall be liable to pay
the sum of twenty-five dollars for each and every offence,
to be recovered by an action of debt, as small debts are
recovered before a justice of the peace, in the name of
the State of Maryland.

SEC. 2. And be it enacted, That it shall be the duty
of the sheriff of the said county, and of the several con-
stables of said county, to enforce the provisions of this
act, against any person who may be found violating the
same, and to collect the penalties hereby provided, and
