1849.

county, be and they are hereby authorised, and em-
powered, and directed, to levy on the assessable pro-
perty of said county, at their levy laying term, in the
year one thousand, eight hundred and fifty, a sum not
exceeding fifteen hundred dollars, to be collected in
two equal annual instalments, to be applied as here-
inafter provided, to the erection and building of a
county jail, in the town of Upper Marlboro'.

CHAP. 372.

SEC. 2. Be it enacted, That John Hodges, Ro-
bert C. Brooke, and Samuel B. Anderson, be and they
are hereby appointed commissioners for the contract-
ing for, and superintendence of the building and erec-
tion of said jail, and they are hereby authorised to
contract with any person or persons to build said jail,
and are required to take and approve a bond or bonds,
with sufficient security, from any contractor or con-
tractors, for the faithful performance of the contract,
in the usual form.

SEC. 3. And be it enacted, That if any one or more
of the said commissioners refuse, or are unable from
any cause, to act under the provisions of this act, then
it shall and may be lawful for the Levy Court of said
county to appoint one or more suitable person or per-
sons to act as commissioner or commissioners under
this act.

SEC. 4. And be it enacted, That the said commis-

sioners, or a majority of them, who shall agree to per-
form and carry out the provisions of this act, shall
have full power and authority to sell and convey the
present site of the old jail, together with the materials
thereof, and to purchase with the proceeds of said sale,
for the use of the county, if, in their discretion, they
should deem it advisable, another and more suitable
site for the erection of the said county jail.

Duty of com-
missioners.

SEC. 5. And be it enacted, That the aforesaid sum
of fifteen hundred dollars, in two equal annual in-
stalments, shall be levied to the use of the aforesaid
commissioners, by the Levy Court of the county afore-
said, and they shall disburse as much thereof to carry
into effect the provisions of this act, and the balance,
if any, after the erection and completion of the said
county jail, shall be by them paid over to the said
Levy Court.

SEC. 6. And be it enacted, That the commission-
ers aforesaid shall pay over to the use of the said Levy
Court whatever surplus sum may remain in their
hands, arising from the sale of the site of the old
jail, and of the materials thereof, and not expended in
