Preamble.
|
WHEREAS, the husband of the said Sophia A. Ro-
bertson has, for many years past, been separate from
her, living in a distant section of the United States,
far beyond the limits of Maryland; and whereas, her
said husband does not, in any way whatsoever, con-
tribute to the support of his. two sons, the maintenance
of the said Sophia A. Robertson, and her children
being entirely dependent upon an annuity of four
hundred dollars, devised to the said Sophia A. Robert-
son, which annuity the Legislature of Maryland has
heretofore, by an act for that purpose, authorised her
to collect and receive, as if she was a feme sole; and
whereas, the husband of the said Sophia A. Robert-
son holds no intercourse with his family, by corres-
pondence or otherwise, but leaves his wife to struggle
for herself and her children; and whereas, the late
Dr. John Murray, of Dorchester county, by his last
will and testament, which is recorded in Liber J C,
number eleven, folio four hundred and thirty one,
one of the record books in the office of the Register
of Wills for Dorchester county, devised certain real
estate to the said Sophia A. Robertson, then Sophia
A. Maxwell, in the vicinity of the city of Baltimore,
and elsewhere; and whereas, the said real estate de-
vised as aforesaid, is unprofitable, not even paying the
taxes thereon, which taxes the said Sophia A. Robert-
son is obliged herself to pay; and whereas, it is de-
sirable that the said Sophia A. Robertson should be
permitted to dispose of the said real estate, with a view
to the support and maintenance of herself and chil-
dren, of which real estate some advantageous dispo-
sition may be made — Therefore,

Be it enacted by the General Assembly of Maryland,
That the said Sophia A. Robertson be and she is here-
by authorised and empowered to sell and dispose of
the said real estate, in fee simple or otherwise, accord-
ing to her will and pleasure, and to execute all proper
conveyances for the same, as if she was a feme sole,
any law of this State to the contrary notwithstand-
ing; provided, that nothing in this act contained shall
be construed to affect any right of the said husband
