SEC. 2. And be it enacted, That all acts, or parts of
acts, inconsistent with this act, be and the same are
hereby repealed.

Inconsistent
acts repealed.

A further supplement to an act to lay out and open a
road through a part of Frederick and Montgomery
counties, passed at December Session, eighteen hun-
dred and forty-four.

1850.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the Commissioners who may be
appointed by the Levy Court of Frederick county, and
the Commissioners of Montgomery county, under the
provisions of the act to which this is a supplement,
are hereby required, after they shall survey and locate
a road, as designated in the said original act, to give
thirty days notice, by advertisement in one newspaper
published in Montgomery county, and in Frederick
county, and also by advertisement set up at some
public places in both counties, in the neighborhood
through which said road shall run, they will receive
sealed proposals on a specified day for the opening of,
said road.

SEC. 2. And be it enacted, That the said commis-
sioners, after the receipt of such proposals as may bet
made, shall proceed to open the same in the presence
of the parties making them, if they choose to attend,
and they are hereby required to give the contract or
contracts to the person or persons who may offer to
open the said road for the lowest price.

SEC. 3. And be it enacted. That the commissioners
are hereby required to take bond or bonds, with ap-
proved security, from the person or persons so agree-
ing to open the same, for the faithful performance of
their contract, which said bond or bonds shall be re-
corded by the said commissioners in the clerk's office,
both in Frederick and in Montgomery counties, and
be liable to be put in suit by either the Levy Court of
Frederick county, or the commissioners of Montgo-
mery county, as the case may be.
