person or persons to build upon, or fence in said pub-
lic ground, or any part thereof, and that any person or
persons who have or shall build upon, or fence in any
part of said lots, and shall not remove the same after
ten days notice, given by the bailiff of said town,
shall be fined a sum not less than five dollars for the
first offence, and ten dollars for each and every week
the same shall remain on said lots.

CHAP. 235.

Sec. 2. And be it enacted, That said corporate au-
thorities be and they are hereby authorised and em-
powered to do any and every thing which is necessary
for the health and convenience of the citizens of the
said town, and that they shall possess the same power
over, and relating to said public ground, that they
now have and possess in respect to other parts of said
town, and that they can and shall pass all ordinances
which they may or can have, in regard to other pro-
perty in said corporation.

Sec. 3. And be it enacted, That this act shall not be
construed so as to interfere with the title of the county
to said public ground, and that the commissioners of
said county shall possess all the powers heretofore
exercised by them over said property.

SEC. 4. And be it enacted, That the bailiffs of said
town shall have the same powers and receive the same
fees as constables in Allegany county are entitled to,
in making arrests, or serving any process for violation
of the ordinances of said corporation, or in the dis-
charge of their duties as bailiffs.

SEC. 5 And be it enacted, That it shall and may be
lawful for the voters entitled to vote at the election for
town councilmen for the town of Cumberland, to vote
for one sensible and discreet person for mayor of said
town, and six sensible and discreet persons as coun-
cilmen for said town, and no more, and the person
receiving the highest number of votes for mayor, and
being eligible, as now required by law, shall be duly
declared elected to serve in the capacity of mayor for
one year, and the person so elected mayor, shall pre-
side in meetings of the council, and have the same
powers of voting and taking a part in, all the acts and
deliberations of the council, as any member thereof,
and the six persons receiving the largest number of
votes as councilmen, having resided in said town for
two successive years prior to such election, and being
assessed on the tax books of said corporation to an
amount of not less than one hundred dollars, shall be
declared duly elected in the capacity of councilmen
for one year.
