CHAPTER 85.
A supplement to the act entitled, an act to incorporate the
Frederick and Emmittsburg turnpike company, passed
at December session eighteen hundred and forty-four,
chapter one hundred and thirty-six.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That as soon as said company shall have
constructed four miles of the said turnpike road in the
manner prescribed by the act to which this is a supple-
ment, and shall have opened the said road to the width
of not less than thirty-eight nor more than fifty feet of
which not less than eighteen feet shall be constructed of
stone or gravel, it shall be lawful for the said company

to erect a toll gate or gales, and charge toll; provided, a
license shall be issued by the Governor, under the seal
or the State, upon application of said company, in the
mode prescribed by the eleventh section of the original
act of incorporation.

|
SEC. 2. And be it further enacted, That the levy court
of Frederick county, at their next session after the pas-
sage of this act may, in their discretion, appropriate the
sum of two thousand dollars for the purpose of erecting
and paying for the erection of bridges on said road, pay-
able in four equal annual payments, and that said levy
court are hereby authorised to levy upon the assessable
property of the county, a sufficient sum of money to
pay the said annual appropriation.

SEC. 3. And be it further enacted, That it shall and
may be lawful for the levy court of Frederick county,
upon the application of any person or persons through
whose lands the old bed of the road passes, and which
may not be occupied by the turnpike road, to order and

direct the same or such parts thereof to be closed; pro-
vided, the public convenience does not require that the
same or such part be kept open, and in case any person
shall consider himself aggrieved by the order of the
said levy court, such person may appeal to the next coun-
ty court, when the case shall be tried in the manner now
prescribed in cases of objections filed to the applications
for public roads.

SEC. 4. And be it enacted, That all parts of the
original act and its supplement, inconsistent herewith,
be and the same are hereby repealed.

take effect from the day of the passage thereof.
