1847.

sand dollars per annum as herein provided, then and in
such case, the amount of fees so returned, after first
deducting therefrom the amount of the allowance herein
after made for the said register, shall be divided among
the said sixteen justices, share and share alike, and the
same shall be in full of all demands on account of their
services as justices of the peace, any thing in this act
contained to the contrary thereof notwithstanding.

CHAP. 77.

SEC. 6. And be it enacted, That the said justices of
the peace, in all cases and for all acts within their juris-
diction and authority, including the taking of acknow-
ledgments of deeds and oilier instruments of writing,
shall demand, collect and receive the fees now allowed,
or that may hereafter be authorised by law, to be de-
manded and received by justices of the peace in and for
the city of Baltimore, and they shall on the first Monday
in each and every month after they shall be qualified to
act as aforesaid, make return on oath or affirmation, and
pay over to the register of the city of Baltimore, for the
use of the said city, all fees received by them as afore-
said, for and during such period, and it shall he the duty
of the said justices at the end of every three months
after they shall have qualified to act as aforesaid, to
make a report on oath or affirmation to the said register,
setting forth the number of cases, civil and criminal,
which during such period shall have been acted upon by,
them, and all the acknowledgments of deeds and other
instruments of writing by them taken, and they shall
also specify in said report the number of days they may
have been absent from their places of official business,
and the reasons thereof.

To report, un-
der oath, all
fees received.

SEC. 7. And be it enacted, That if any of the said
justices of the peace shall in any instance fail or neglect
to make a monthly return or payment as aforesaid, or
quarterly report as aforesaid, and shall neglect so to do
for one week after the time at which the same should be
made, it is hereby made the duty of the register of the
city of Baltimore to notify the Governor of such omission
or neglect, who after first giving notice to such justice
of the peace, and his not adducing goad and sufficient rea-
sons for the omission aforesaid, or if he shall omit to make
such return or payment on or before a day that may be
named by him for that purpose, shall be and he is
hereby authorised and required to remove from office
such delinquent justice of the peace, and appoint
some other person to serve out the residue of the term,
and it is hereby made the duty of the said register forth-
with to institute suit upon the bond of such defaulting
