as the case may be when required, and shall make act
dividend of the clear profits and income thereof not
exceeding ten per centum among the stockholders,
which dividend shall he declared half yearly, in the
months of January and July, and published and paid
accordingly.

CHAP. 314.

SEC. 21. And be it enacted, That it shall not be

lawful for said company to ask, demand or receive of
or from any person or persons, within the lines of
whose lands any gates may he erected any toll for pass-
ing from one part to another part of said land along said
road.

SEC. 22. And be it enacted, That nothing in this
act shall be so construed to allow said company to issue
any note, token, scrip, certificate or other evidence of
debt to he used as a currency.

SEC. 23. And be it enacted, That this act of incor-
poration shall continue in force lor fifty years, and that
the General Assembly hereby reserves the right to alter,

amend or repeal this act at pleasure.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Matthew Topham Evans, William M.
F. Magraw, Thomas Johnson Evans, Thomas J. John-
son and all and every person who shall become asso-
ciated with them in the manner hereinafter prescribed,
shall be and they are hereby incorporated by the

such shall have succession, and may have and use a
common seal, and be able and capable to sue and be
sued, plead and be impleaded in any court of law or
equity, and may have, use, exercise and enjoy all
the powers, privileges and rights proper and necessary
for carrying on the mining of coal, and for opening,
working and vending the produce of their lands and
mines, and shall have power to take, purchase and hold
all such property, real, personal or mixed that they may
require for the purposes aforesaid, and shall have power
to make and enter into all manner of contracts in re-
