CHAP. 313.

capital stock of said company to such extent as shall be
deemed sufficient to accomplish the work, and receive
subscriptions on the original terms as before provided
for in the second, third and fourth sections of this
act.

To put up
mile stones —

facing.

SEC. 18. And be it exacted, That the said com-
pany shall cause milestones to be placed at the side of
said roads, beginning at the distance of one mile from
the southern end of the road, and extending thence to
the termination of the said road, whereon shall be
marked in plain legible characters the number of miles
which each stone is distant from Mechanicstown or
the point where the said road connects with the Fre-
derick and Emmittsburg Turnpike Road, and if any
person shall wilfully destroy the said milestones or de-
face the same, or shall without the permission of the
acting superintendents of the said road, throw out upon
the road and suffer to remain for the space of one day
any mould, dirt or rubbish of any kind, such person be-
ing convicted thereof by the evidence of one or more-
credible witnesses and disinterested ones before any
justice of the peace of Frederick or Washington coun-
ty, as the case may be, he or she shall be judged by the
said justices to pay a line not exceeding ten dollars, to
be recovered with costs, which fine shall when recovered
be paid to the treasurer of the company for the use
of said company.

Not to obstruct
road— penalty.

SEC. 19. And be it enacted, That all wagoners and
drivers of carriages of all kinds, whether of burden or
pleasure, using the said road shall, except when passing
by a carriage of slower draught, keep their horses and
carriages to the right hand of said road in passing
direction, leaving the other side of the mad free and
clear for other carriages to pass and re-pass, and if any
driver shall offend against this provision he shall for-
feit and pay not exceeding ten dollars to any person
who shall be obstructed in his passage and will war-
rant for the same to be recovered with costs before any
justice in the same manner as debts under ten dollars
are recoverable, and all fines and forfeitures imposed by
this act not exceeding ten pounds shall be recoverable
before any justice in the same manner as debts under
ten dollars are recoverable.

Dividends—
how and when
declared.

SEC. 20. And be it enacted, That the president and
managers of said company shall keep a just and true,
account of all monies received by their respective toll
gatherers at their several and respective gates on said
road, which account shall be upon oath or affirmation
