CHAP. 224

Vacancies—
how filled.

turn of such election, and if any commissioner or com-
missioners shall die, resign, remove from the district,
refuse or neglect to qualify agreeably to the original act
to which this is a supplement, and the further supple-
ment passed December session eighteen hundred and
thirty-eight, chapter two hundred and one, that the
Governor is hereby authorised and required to order an
election to fill such vacancy or vacancies, giving at least
twenty days notice of said election, which shall be by
a vote of the whole county, confining the residence as
aforesaid to the district or districts where such vacancy;
or vacancies may happen.

Rights vested.

SEC. 5. And be it enacted, That the said commissioners,
or a majority of them, hereby authorised to be elec-
ted by the provisions of this act, shall have, hold and
exercise all the powers, rights, privileges and immuni-
ties that the commissioners of said county now do un-
der and by the provisions of the original act to which this
is a supplement, and the several supplements thereto.

Inconsistent
acts repealed.

SEC. 6. And be it enacted. That all acts or parts of
acts inconsistent with the provisions of this, be and the
same are hereby repealed, any law, custom or usage to the
contrary notwithstanding.

An act to open and widen Carrol Creek, in Frederick

City.

Preamble.

WHEREAS, it is represented to this General Assem-
bly by sundry citizens of Frederick city, that the lower
part of said city is subject to frequent and destructive
floods in Carrol creek — Therefore,

Creek to be
widened.

Be it enacted by the General Assembly of Maryland,
That the mayor, aldermen and common council of Fre-
derick; and their successors, be and they are hereby au-
thorised and empowered to open and widen the chan-
nel of Carrol creek, at, near and along where Patrick
street crosses said creek, and at, near and along any other
parts of Frederick on said creek, where it may be neces-
sary, so as to, prevent any part of Frederick from being
inundated by floods in said creek, and the said corporation
of Frederick are hereby authorised and empowered to
condemn any property whatsoever that may be necessary
