CHAPTER 223.

An act supplemental to an act entitled, an act to provide
for electing Commissioners for Baltimore county, and
prescribing their powers and duties, passed at Decem-
ber session eighteen hundred and twenty-six, chapter two
hundred and seventeen.

SECTION 1. Be it enacted by the General Assembly
Maryland, That from and alter the passage of this act
the persons qualified to vote for delegates to the Gen-
eral Assembly in Baltimore county, at the time and
places of election in said county, on the first Wednes-
day in October next, shall vote by ballot for three per-
sons having the same qualifications as are required for
delegates to the General Assembly, to be commissioners
for Baltimore county, and the judges of election for the
several election districts are required to certify and re-
turn under their hands the number of votes given in their
respective districts for commissioners as aforesaid,
agreeably to the provisions of the original act to which
this is :a supplement.

SEC. 2. And be it enacted, That the mode of elec-
ting commissioners shall be as follows: the first, second,
third and fourth election districts shall compose the
first commissioners district and elect one commissioner,
the fifth, sixth, seventh, tenth and eleventh election dis-
tricts shall compose the second commissioners district
and also elect one commissioner, and the eighth, ninth
and twelfth election districts shall compose the third
commissioners district, and also elect one commissioner
in like manner.

SEC. 3. And be it enacted, That in voting for com-
missioners as aforesaid, it shall be by a general vote of
the whole county, confining the residence nevertheless
of each commissioner to the commissioners districts as
aforesaid, and the person receiving the highest number
of votes shall be elected for three years, and the next
highest in number shall be elected for two years, and
the next highest in votes for one year, and their places
respectively shall be supplied by the annual election of
one commissioner in like manner, and with the same
qualifications to serve three years.

SEC. 4. And be it enacted, That if an equal num-
ber of votes shall be given to two or more persons
voted for, as commissioners, the judges of the election
shall in that event determine the election between those
persons by lot, and certify said proceedings in their re-
