to effect the object aforesaid; provided always, that if
compensation be required by any person or body corpo-
rate whose property may be injured in so opening and
widening the channel of said creek, and said person or
body corporate cannot or will not agree with said cor-
poration of Frederick as to the amount of compensation
for the injury so done to their property, then and in that
case application may be made to the Frederick county
court, whose duty it shall be to direct the sheriff of Fre-
county to summon five respectable men of his bailiwick,
to view and value the injury, if any, that may have been
done to the rights or properly of said person or body
corporate as aforesaid, and from whose decision either
party may appeal to the county court who shall give
judgment according to the equity and right of the matter,
which decision shall be final.

Proviso.

An act relating to Constables fees in criminal cases, and
writs of venditioni exponas on Magistrates' judgments,
so far as, the same relates to Kent County.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That all constables in Kent county shall be
entitled to receive in addition to the fifty cents now al-
lowed by law the sum of eight cents per mile for every
mile they may have to travel to and from the jail in
Chestertown, in delivering over to the jailer of Kent
county any person or persons at the same time who may
be committed for any breach of the peace, failure to
give security for appearance to court on any criminal
charge, and for any criminal offence whatever, to be

levied upon Kent county and paid as other charges

against the said county; provided, that the constable
shall not receive more than four dollars for any one de-
livery aforesaid, the distance to b6 computed from the
place where the commitment shall be issued, and from
the sold jail to the residence of the constable; and pro-
vided also that the said sum of eight cents per mile
shall be levied and paid in such cases only as the levy
court of Kent county, shall in their discretion allow, as
a reasonable additional compensation for any extra trou-
ble or risk that the said officers may incur in the per-
formance of the said duty.
