CHAP. 198.

March 2, 1848.

CHAPTER 198.
An additional supplement to the act entitled, an act to
alter and change the name of Elizabethtown, in
Washington County, to Hagerstown, and to incor-
porate the same.

Corporation to
consist of a
mayor and five
councilmen.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the corporate body of said town shall
hereafter consist of a Mayor and five Councilmen,
to be styled the Mayor and Council of Hagerstown,
with all the powers and immunities heretofore granted
to the moderator and commissioners of said town.

Mayor to be
elected for two
years and the
councilmen for
one.


SEC,. 2. And be it enacted, That instead of electing
five commissioners at the time and in the manner pre-
scribed by the original act to which this is an additional
supplement, the persons qualified to vote shall, on the
second Monday of April next meet, and on the same day
in every second year forever thereafter, elect the mayor
to serve for two years, and shall at the same time in
each and every year forever thereafter elect five coun-
cilmen, one for each ward in said town, to serve for
one year, the said Mayor and Council to possess the
same qualifications and eligibility as are now required
of the moderator and commissioners of said town.

Vacancy —
how to be filled.

SEC. 3. And be it enacted, That in case of the
death, refusal, disqualification, resignation or removal
of the mayor out of the taxable limits of the town, the
council for the time being shall elect a mayor for the
residue of the term.

Major to ex-
ercise powers
of a justice of
the peace.

SEC. 4. And be it enacted, That the Mayor shall
in virtue of his office have and exercise all the juris-
diction and powers of a justice of the peace in Wash-
ington county, and for which service he shall be enti-
tled to receive the same compensation that is allowed
by law in similar cases to justices of the peace in said
county.

Compensation.

SEC. 5. And be it enacted, That the major and
each member of the council shall be entitled to the
same compensation as is now allowed to the modera-
tor and commissioners.

To take an
oath.

SEC. 6. And be it enacted, That the Mayor and
Council shall, before they act as such, take the oath pre-
scribed in the tenth section of the act to which this is

sent, shall preside at all meetings of the council, and
