1847.

lectors of tolls for crossing said bridge, and shall make
and declare a dividend of the profits and income there-
of among all the stockholders, first deducting there-
from all proper expenses or incidental costs and
charges and such proportions of the said income as
they may deem necessary to provide against the decay
and for the repairing the said bridge, and shall on every
first Monday in July and January of every year publish
the dividend to be made of the said clear profits there-
of among the stockholders, and also the time and place
when and where the same shall be paid, and shall cause
the same to be paid accordingly.

CHAP. 197.

SEC. 11. And be it enacted, That if any person or
persons shall wilfully injure any part or parcel of said
bridge, he shall forfeit and pay to the president and

directors for every such offence a sum not exceeding
fifty dollars, to be recovered before any justice of the
peace of Frederick county, and he, she or they so of-
fending may and shall remain liable to actions at the
suit of the president and directors for further damages
for such offence if the sum or sums herein mentioned
be not sufficient to repair and satisfy such damages.

Penalty for

SEC. 12. And be it enacted, That any person or

persons owning the ferry across the Potomac river, at
the town of Berlin, in Frederick county, Maryland,
shall be deprived of any fights or otherwise injured by
the provisions of this act, said person or persons shall
be entitled, upon application in proper form and to the
proper authority, to have the damages sustained by him,
her or them in consequence of such deprivation or in-
jury, assessed by a jury in the usual form for cases of
damage made and provided, and said Berlin and Poto-
mac Bridge Company shall be answerable to said per-
son or persons for said damages so ascertained, in
common property held by such company under the
provisions of this act.

SEC. 13. And be it enacted, That nothing in this act
Contained shall be construed to authorise said company
to issue any note, token, scrip or device to be used as a
currency, and the legislature reserves to itself the right
to alter, amend and repeal this charter at pleasure.
