1847.

county court as a court of equity, and upon the return
of commissioners appointed by the chancellor or said
court for the purpose of examining and reporting
whether a sale of said parts or parcels of the real estate
of the said Thomasina H. Gist would be advantageous
to her, the Canceller or said court shall and may pass
a decree for the sale of all such parts or parcels of the
real estate of said Thomasina H. Gist, in Baltimore
county, as the said commissioners shall report to the
chancellor or to Baltimore county court, as the case may
be, that it would be to her interest and advantage to have
sold, and by such decree shall appoint a trustee or trus-
tees to sell and convey the same to the purchaser or
purchasers thereof, or of any part or parts thereof, which
trustee or trustees shall give bond with penalty, and re-
port the sale or sales made by him or them in the same
manner as is usual in cases of sales made under decrees
of said courts, and the chancellor or said court shall
and may order and direct the said trustee or trustees to
apply the proceeds of such sale or sales to the payment
of such balance of purchase money as may be due

from them as aforesaid by the trustees above named, and
to invest the surplus of such sale or sales in real Or per-
sonal estate, or both, as the chancellor or Baltimore coun-
ty court may direct.

CHAP. 191.

SEC. 2. And be it enacted, That in case said invest-
ment or any part thereof shall be made in real estate,
it shall descend upon her death as if she hail become
seized thereof by descent from her father, and if such
investment or any part thereof shall be made in person-
al property, or in case she die before such investment,
then and in that case such personal property shall be
regarded as real estate which descended to her from
her said father.

An act to incorporate a company for constructing a
bridge across the North Branch of the Potomac river,
at or near the mouth of New creek.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That Richard D. Johnson, Thomas
Sanderson, George W. Clabaugh, Joseph McCarty,
