CHAPTER 190.
A supplement to an act passed at December session; eight-
teen hundred and thirty-eight, chapter one hundred
and thirty, entitled, an act for the relief of Thoma-
sina H. Gist, an Orphan .

Preamble.
|
WHEREAS, Baltimore county court, in pursuance of
the power granted by an act of the General Assembly
of Maryland, passed at December session eighteen hun-
dred and thirty-eight, chapter one hundred and thirty,
did. appoint Samuel I. Donaldson and Hugh Davey
Evans of the city of Baltimore, trustees to sell certain
lands in Baltimore and Carroll counties, belonging to
Thomasina H. Gist, infant daughter of Thomas H. Gist,
late of said county, deceased, and to invest the proceeds
of such sale or sales in other lands, as directed by said
act of Assembly; and whereas, the said trustees, with a
view to such investment of said proceeds of sales, did
contract to purchase from the heirs of James E. Lyon,
late of Baltimore county, deceased, a tract of land ad-
joining the principal estate of the said Thomasina H.
Gist; and whereas, the said purchase was made before
the said trustees had sold all the lands, consisting of a
great number of parcels, which by the said decree they
were authorised to sell, and they have since sold all of the
said lands, and the proceeds of the sale are insufficient
to pay the full amount of the purchase money for the
said tract of land purchased from the heirs of Lyon;
and whereas, it is represented to this General Assembly,
that the said tract of land is an important addition to
her estate in Baltimore county, but that she is seized of
a large real estate in said county, various ports of which
it would be to her interest and advantage to have sold,
out of the proceeds of the sales of which the said
balance of purchase money might be paid, and the
surplus advantageously invested tor the said infant; and
whereas, the effect of said sales would be to change the
course of descent of said property, and without legisla-
tive provision the proceeds of such sales could not be
applied to pay the balance of said purchase money, for
all which reasons it seems desirable that this General
Assembly should pass some special act in the premises—
