CHAPTER 141.
An act explanatory of a supplementary act, passed De-
cember session eighteen hundred and forty-six, chapter
three hundred and fifty-three.

WHEREAS, Doubts are entertained in regard to the
true construction of certain parts of an act of assembly,
passed December session eighteen hundred and forty-
six, chapter three hundred and fifty-three — There;
fore,
|
Preamble.
|
|
|
|
SECTION 1. Be it enacted by the General Assembly
of Maryland, That where elections have been, or may
hereafter be held, according to the provisions of said
act, and a majority of the voters in any school district
where such election may be held, shall decide against
making the school in said district a primary school,
nevertheless, the trustees elected in such school district
at such election, shall have entire control over the school
therein during their term of service, and shall receive
their proportion of all the school funds in the manner
provided by law before the passage of the act of eigh-
teen hundred and forty-six, chapter three hundred and
fifty-three.

SEC. 2. And be it enacted, That the reference in
section nineteen shall be one hundred and fifty-seven,
instead of fifty-one, and that the term most convenient
used in the seventeenth section of said act, shall be con-
strued as to mean the nearest, and that the twentieth
section of said act shall not apply to any school district
wherein a majority of the voters thereof shall have de-
cided or shall hereafter decide against the primary school
system.

SEC. 3 And be it enacted, That it shall be the duty of the
trustees of each primary school established in accordance
with the provisions of the act of eighteen hundred and
forty-six, chapter three hundred and fifty-three, to return
on the first day of January of each and every year, to the
commissioners of the charity school fund a list of all
such scholars attending their respective schools, as un-
der the law of eighteen hundred and thirty-four, chapter
two hundred and twelve, section six, are denominated
charity scholars, together with the number of days
which such scholars attended, and that the commission-
ers of the charity fund shall allow the trustees of such
primary schools their proportion of the charity fund.
