CHAP. 136.

Proviso.

In force.

cal Lutheran Church of Frederick, and their succes-
sors; provided, that no patent shall be issued until the
usual Tees of office shall be first paid.
SEC. 3. And be it further enacted, That this act shall
take effect from the date of its passage.


CHAPTER 135.

Passed
March 1,1848.

A supplement to the act entitled, an act to regulate the
height of fences in Allegany County, and for other
purposes, passed at December session eighteen Hundred
and forty-six, chapter one hundred and forty-one.

Damages re-
coverable.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That if any person within the limits of
Allegany county, shall dog, beat, bruise or otherwise
injure any horned or black cattle, sheep or hogs, he
shall be liable for the actual damage thereby occasioned
to the said horned or black cattle, sheep or hogs, to the
owner thereof, to be appraised by two disinterested
persons, one of whom shall be chosen by each party,
the said damage to be recovered before any justice of
the peace in and for Allegany county, in the same
manner as small debts are now collected out of court.

Repealed.

SEC. 2. And be it enacted, That the second section of
the act of eighteen hundred and forty-six, chapter
one hundred and forty-one, be and the same is here-
by repealed.

CHAPTER 136.

Feb. 28, 1848.

Levy autho-
rised.

An act to compensate G. J. Spalding, for services
therein specified.

Be it enacted by the General Assembly of Maryland,
That the commissioners of tax for Saint Mary's coun-
ty be, and they are hereby authorised and empowered,
at the next annual levy for said county, to levy upon the
assessable property of said county, for the use of George
S. Spalding, such sum as to them shall appear a fair
compensation for the services rendered by him in
compliance with an order adopted by the House of
