LAWS OF MARYLAND.

CHAP. 48.

creek, they shall be of opinion that the same could be so
altered and amended as to secure to the public a good,
safe and convenient road, at an expense less than the
laying out and construction of a new road, then the said
alteration and amendment of the present road shall be
made; otherwise, a new location and construction of a
road, is hereby authorised and directed to be made by
said commissioners, or a majority of them.

To employ
persons to con-
struct.

SEC. 3. And. be it enacted, That if a new road shall
be deemed advisable by the commissioners above named,
or a majority of them, they the said commissioners, are
hereby authorised and empowered to employ such person
or persons as they may deem most advantageous for the
interest of the county, to construct the same, and on the
final completion, and opening of said new road, the ground
on which the present road is now travelled, shall revert
to the original proprietors thereof and to their successors,
and the present proprietors shall have full power and au-
thority to close up the same, in any manner they may
think proper.

Authorised to
alter, &c.

SEC. 4. And be it enacted, That if the commission-
ers above named, or a majority of them, shall deem it
most advantageous for the public interest, to alter and
amend the present road, they shall have for the same,
power and authority as is vested in them by the third
section of this act, to have the same so altered and
amended.

Road com-
missioners to
make return.

SEC. 5. And be it enacted, That the road commission-
ers shall return a full and accurate statement of all
their proceedings to the commissioners of Allegany
county, at their annual meeting in August next, when
the county commissioners shall examine and record the
same, and if the expenses for making a new road, or al-
tering the old one, shall be deemed just and reasonable,
they are hereby authorised to direct the same to be paid
in the same manner that other road charges are paid in
said county.

Proprietors to
consent.

SEC. 6. And be it enacted, That neither a new road,
or any alteration or amendment shall be made in the old
one, unless the proprietors of the land through which the
same may pass, shall first consent and agree to relinquish
the land for the use of the road, in either case, to Alle-
gany county, free of all charges for the same.
