CHAPTER 272.

An act empowering the Commissioners of Carroll County
and the Levy Court of Frederick County, if they deem
it expedient, to levy a sum of money not exceeding six
thousand dollars, to build a Bridge over the Monocacy
River, on the road leading from Taneytown, in Car-
roll County, to Emmittsburg, in Frederick County.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That from and after the passage of this act,
the commissioners of Carroll county and the levy court
of Frederick county be, and they are hereby authorised
and empowered, if they deem it expedient, to levy on
the assessable property of their respective counties, a
sufficient sum not exceeding three thousand dollars in
each county, to build a substantial bridge over the river
Monocacy, on the road leading from Taneytown, in Car-
roll county, to Emmittsburg, in Frederick county.

Adopt plan
and give no-
tice.

SEC. 2. And be it enacted, That it shall be the duty of
the commissioners of Carroll county and the levy court
of Frederick county, to adopt a pJan, according to which,
said bridge shall be constructed, and of such materials as
they may think best, of which due notice shall be given
in two or more newspapers in each counly, for the space
of four weeks, for the purpose of receiving proposals for
the building of the same according, to said plan.

May contract.

SEC. 3. And be it enacted, That the commissioners of
Carroll county and the levy court of Frederick county
be, and they are hereby authorised, after the notice afore-
said, to contract with any person or persons, to build
said bridge, and to take bond or bonds with sufficient
security, from any person or persons contracting as afore-
said, for the faithful performance of their contract.

Accept the
lowest bid.

SEC. 4. And be it enacted, That it shall be the duty
of the commissioners and the levy court aforesaid, to
accept the proposal of the lowest bidder or bidders; pro-
vided, he or they shall give sufficient security for the
faithful performance of his or their contract foi the
same.

Free bridge.

SEC. 5. And be it enacted, That when said bridge shall
have been completed, it shall be a free bridge for all
persons to pass and repass.

Expense to be
equally divi-
ded.

SEC. 6. And be it enacted, That the expense of build-
ing said bridge shall be equally divided between the two
counties, which shall not exceed the sum of six thousand
dollars.
