CHAPTER 86.
An act to cure the defect in the acknowledgement of a deed
of mortgage from John Ashbaugh to Jacob Hann and
Mathias Hann.

Preamble.
|
WHEREAS, the acknowledgement of the said deed of
mortgage is in the following words, to wit: State of
Maryland, Frederick county, to wit: be it remembered,
and it is hereby certified, that on this fifth day of April,
in the year of our Lord one thousand eight hundred and
forty-four, before the subscribers, two justices of the
peace of the State of Maryland, in and for the county
aforesaid, personally appears John Ashbaugh, he being
known to us to be the person who is named and described
as and professing to be a party to the foregoing deed or
indenture, and doth acknowledge the said indenture or
instrument of writing to be his act and deed; and whereas,
doubts are expressed whether the certificate in the afore-
said acknowledgement in the words, he being known to
us to be the person who is named and described as and
professing to be a parly to the foregoing deed or inden-
ture, is agreeably to the requirement of the act passed at
December session, eighteen hundred and thirty-one,
chapter two hundred and five — therefore,

Confirmed and
made valid.
|
Be it enacted by the General Assembly of Maryland,
That the deed of mortgage from John Ashbaugh to
Jacob Hann and Mathias Hann, which bears date the
fifth day of April, in the year eighteen hundred and forty-
four, and is recorded in Liber H. S., number twenty-
two, folios two hundred and fifteen and two hundred and
sixteen, one of the land records of Frederick county, be
and the same is hereby confirmed and made valid, not-
withstanding the said deed of mortgage may not have
been certified by the takers of the acknowledgment of the
said deed of mortgage, as required by the act of Decem-

ber session, eighteen hundred and thirty-one, chapter
two hundred and five; provided, that in all other respects
the said deed of mortgage has been executed, acknow-
ledged and recorded, agreeably to the provisions of the
law.
