CHAP. 78

devised the same to Rebecca Perry, since married to
Thomas Gaither, and Ann Stewart, now a minor; and
whereas, it is represented to this General Assembly that
the said land is of very small value, and by reason of the
minority of one of the devisees cannot be sold without
a decree of the court of chancery, at a cost which would
be too heavy to be borne by said devisees, who are rep-
resented to be very poor — therefore,

Appointed
trustee to sell
a piece of land.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Edward Dubois, of the city of Annapo-
lis, be and he is hereby appointed trustee to sell said
piece of land, at public or private sale, for cash or on
credit, as to, him may seem best, first giving three weeks
public notice of the time, place and terms of sale, and
filing with the register of wills of said county, a bond to
the State of Maryland, in the penalty of one hundred
and fifty dollars, with sureties, to be approved by the
orphans' court of said county, conditioned for the faith-
ful performance of his duly.

Power to con-
vey.

SEC. 2. And be it enacted, That upon the payment of
the whole purchase money, and not before, the said trus-
tee shall have power to convey to the purchaser or pur-
chasers, the title of the said devisees.

Suit.

SEC. 3. And be it enacted, That suit may be brought on
an official copy of said bond, in the same manner that
suits are now brought on the bonds of trustees appointed
by the court of chancery.

Trustee to pay
ever.

SEC. 4. And be it enacted, That the trustee shall pay
over to the orphans' court of Anne Arundel county, the
amount of the purchase money when received, with in-
terest if sold on a credit, to be distributed according to
law by said court.

An act entitled, an act for the relief of A. St. C. Heiskell,
of Prince George's County.

WHEREAS, by an act of the General Assembly of
Maryland, passed at December session, eighteen hun-
dred and forty-four, chapter thirty-seven, A. St. C. Heis-
kell, of Prince George's county, was authorised and em-
powered to hold and retain in this State certain negro
slaves, upon the terms and conditions therein set forth;
and whereas, it has been represented to this General As-
