CHAP. 41.

CHAPTER 40.

Passed Jan.
27, 1846.

An act to authorise the citizens of Worcester county to
plant Oysters, Clams or other Shell Fish, and for the
protection of the same.

Authorised to
plant, &c.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That from and after the passage of this act, it
may and shall be lawful for any citizen of Worcester
county to lay or plant out oysters, clams or other shell
fish, within the limits of said county.

Not more than
one acre.

SEC. 2. And be it further enacted, That any person or
persons so planting oysters, clams or shell fish, are, by
this act, authorised to stake off for their use and benefit,
not to exceed one acre, which shall be their bona fide
property to them, their heirs or assigns, for the space of

five years from the dale thereof; provided, that the per-
son or persons staking off the same have a survey made
by the county surveyor, whose duty it shall be to give a
certificate of the same to cadi and every person as above
stated, and said certificate then shall be placed among the
records of said county, in the same manner and form that
deeds are recorded; and provided further, that the said
survey, when so made, shall not embrace any rocks
whereon oysters or clams or other shell fish are growing
at the time of the making the aforesaid survey.

Penalty.

SEC. 3. And be it further enacted, That if any person
or persons are found guilty of stealing or otherwise felo-
niously taking oysters, clams or other shell fish so laid
out or planted, they shall be dealt with as the law of this
State directs in other cases of theft or felony.

CHAPTER 41.

Passed Jan.
26, 1846.

An act to build a bridge across Fishing Creek, at Utica
Mills, on the road leading from Frederick to Emmits-
burg, in Frederick county.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the levy court of Frederick county be,
and they are hereby authorised, in their discretion, to
levy upon the assessable property of Frederick county a
sum of money not exceeding five hundred dollars, for the
purpose of building a bridge across Fishing creek at
