1845.

heretofore indicted by the grand jury of Kent county,
for encroachments upon the public streets and alleys of
Chestertown; provided, the said judges shall be of opin-
ion, that such encroachments do not prejudice the public.

CHAP. 289.

Proviso.

SEC. 3. And be it enacted, That the said commis-
sioners may use and hold the buildings on the public
square, known as the old clerk's office, for the purpose
of holding their meetings and keeping their records and
papers.

SEC. 4. And be it enacted, That said commissioners
shall annually, between the first day of April and the first
day of May, publish at the court house door and in a
newspaper published in Kent county, if there be one pub-
lished, an abstract, showing the amount of taxes levied
for the previous year, up to the period of publication, in-
cluding all taxes levied on the property in said town, all
money collected for license and due for the same; all
fines and the total income from every source, and also
the expenditures of the said board of commissioners, for
the said year, stating each class of expenditure, and the
balance due to or from the said commissioners, so that
the inhabitants of the town may be informed of the finan-
cial condition of the corporation.

SEC. 5. And be it enacted, That in case the com-
missioners shall refuse or neglect to comply with the re-
quirements of the fourth section of this act, they may be
presented by the grand jury and fined individually, by
the county court, in such sum as the said court, in their
discretion may deem right and proper, not exceeding ten
dollars for each person; and the said fines, when col-
lected, shall be paid to the clerk of the county or treasu-
rer of the school fund, to be appropriated to the support
of the primary schools, held in said town, and the pub-
lic funds of the town, shall not be answerable for the said
fines or fees, consequent upon the same.

SEC. 6. And be it enacted, That this act shall go into
operation, from the passage hereof.


CHAPTER 289.

Go into effect.

A supplement to the act, entitled an act to authorise and
empower the County Court of this State, to extend the
time of Sheriffs and Collectors of the County and State
Taxes, to complete their collections.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That on the application of any of the par-
