ground of the extent of one half acre of land and no more,
commencing at low water mark and running in the shape
of a square from said low water mark along the margin of
said river, for a public landing, on the lands of Col. William
Hughlett, formerly the property of Robert Lloyd, and
others, situate on the Choptank liver, called and known as

SEC. 2. And be it enacted, That the said commissioners
or a majority of them, be and they are hereby authorised
to condemn and make public, a road leading from the pub-
lic road in Landing Neck, through said farm, to the afore-

said landing; provided, that nothing in this act shall be so
construed as to prevent the owner or owners through
whose lands said road may pass, from having the privi-
lege of keeping a free gate or gates on said road; and pro-
vided also, the said commissioners herein before named,
shall adopt the present road leading down to said Lloyd's
Landing, if in their judgment, they deem the same an eli-
gible and proper one.

Provisoes.

SEC. 3. And be it enacted, That said commissioners or
a majority of them, are hereby directed to return a plat of
said landing and road, when surveyed, marked, laid out
and made public us aforesaid, to the clerk of the county
court, to be by him recorded, which landing and road shall
forever hereafter be deemed and taken as a public landing
and road, and shall be kept up and repaired as other public
landings and roads in said county are.

SEC. 4 And be it enacted, That the aforesaid commis-
sioners or a majority of them, shall ascertain the amount
of damages, which any person or persons may sustain by
the laying out, marking and condemning said lot of ground
and road, which amount they shall return to the commis-
sioners or levy court of Talbot county, who are hereby
authorised and directed to levy upon the assessable proper-
ty of said county, a sum sufficient to cover all damages,
and pay the same to the person or persons entitled thereto,
including two dollars each, for every day said commis-
sioners shall attend in the discharge of the duties enjoined
upon them, and a reasonable compensation to the survey-
or for his services, by virtue of this act.

SEC. 5. And be it enacted, That should the said William
Hughlett, through whose lands the said road is to pass,
and whose property is hereby ordered to be condemned as
a "public landing, " deem himself aggrieved by the action
or decision of said commissioners herein named, he shall
have the right of appeal thereon to Talbot county court,
the judges of which shall have power to hear and decide
all matters connected therewith.
