C H A P.
XXV.

Penalty on
chimnies catch-
ing fire, &c.

Tax for keep-
ing dogs, &c.

III. AND BE IT ENACTED, That if any person residing in said village shall permit or suffer his
or her chimney to catch fire, so as to blaze out of the top, such person or persons shall forfeit and
pay the sum of three dollars for every such neglect,

IV. AND BE IT ENACTED, That if any person residing in the said village shall keep or suffer any
dog or bitch to remain about his or her house for the space of one week, such person shall pay the
sum of fifty cents, on or before the first day of January annually.

to be recovered,
&c.

V. AND BE IT ENACTED, That the fine laid on any person whose chimney takes fire as aforesaid,
and the tax on dogs and bitches, shall be recovered in the name of the trustees of Hillsborough
school, before a justice of the peace, as in the case of small debts, and the money arising therefrom
to be applied by the said trustees to the payment of the tuition of poor children at the said school,

VI. AND BE IT ENACTED, That the trustees of Hillsborough school, or a majority of them, shall,
at their first meeting after the first day of March in every year hereafter, appoint a fit person re-
siding in the village aforesaid to be bailiff, who shall have power, under their direction, or the di-
rection of any justice of the peace who may reside therein, to execute this law, and the duties of a
constable, other than the serving warrants for small debts,

 

CHAP. XXVI.

Passed 31st of
Dec. 1806.

An ACT for the benefit of John Munickhuysen, Jacob Munick-
huysen, William Munickhuysen and Edward W. Munickhuysen,
minors, of Baltimore county.

Preamble.

WHEREAS it has been represented to this general assembly, by the petition of Mary Munick-
huysen, of Baltimore county, guardian of John Munickhuysen, Jacob Munickhuysen, Wil-
liam Munickhuysen and Edward W. Munickhuysen, minors, and children of John Munickhuysen, late
of said county, deceased, that the said John Munickhuysen died seized of and in seven lots or par-
cels of ground, the first six distinguished, on a plot of Yates and Bowly's addition to Baltimore, by
the numbers thirty-five, thirty-six, thirty-seven, sixty, sixty-one and sixty-two, and the seventh in
Light-street, in the said city, sold to the said John, in his life-time, by Mark Pringle: And where-
as it is stated, that the said lots must be more expensive than profitable, if permitted to remain in
their present situation, and that it would be highly advantageous to said minors to have the same
leased out; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the said Mary Munickhuysen k
and is hereby authorised and empowered to lease out the above-mentioned lots, or any one or
more of them, on such terms as the orphans court of Baltimore county shall think advantageous to
the said children, reserving rent therefor, to be paid to the guardian, who shall account therefor
annually to the orphans court of Baltimore county, until the aforesaid children shall be of age, and
after that period to the said children.

Leases, &c. to
be valid, &c.

III. AND BE IT ENACTED, by the General Assembly of Maryland, That all leases executed by the
said Mary Munickhuysen, and other acts by her done in the premises., with and by the consent of
the said orphans court, shall be as valid and effectual as if done by the said John Munickhuysen in
his life-time.

CHAP. XXVII.

An ACT to authorise commissioners to review the roads leading
through the plantation of Henry Hershberger, of Frederick county.

Preamble.

WHEREAS it is represented to this general assembly, by the petition of Henry Hershberger,
of Frederick county, that he is possessed of a tract of land lying in said county, at which
place a number of roads centre, to the great injury and inconvenience of the said petitioner; and
the said petitioner having prayed that an act may pass, authorising commissioners to shut up a cer-
tain part of the road in the petition aforesaid mentioned, and the inconvenience being trifling to the
public, in comparison to that which the said Hershberger labours under, and especially as there still
will remain a road through a part of his land for public use; and the prayer of the petitioner ap-
pearing reasonable, therefore,

II. BE IT ENACTED, by the Gene rat Assembly of Maryland, That Patrick M'Gill, William Luckett
James Samuel Hook, James Simmons and Daniel Lakin, be and they are hereby authorised and
