appointed commissioners, with full power and authority to enter on the lands of the said Henry
Hershberger, and if, upon viewing the premises, and the roads that run through the same, they
shall be of opinion that no material injury would result to the public by shutting up the said road,
then the said commissioners, or a majority of them, shall return a certificate, under their hands and
seals, to the clerk of the county court, certifying their opinion and determination respecting the
premises, and the clerk of the said court shall record the same, then, and not before, the said Hen-
ry Hershberger shall have full power and authority to shut up the said road.

III. AND BE IT ENACTED, That the expences arising in the execution of this act shall be paid
by the said Henry Hershberger.

CHAP. XXVIII.

Expences to be
paid, &c.

An ACT authorising Thomas Bailey, late sheriff and collector of
Baltimore county, to complete his collection, and for other pur-
poses.

Passed 31st of
Dec. 1806.

WHEREAS it is represented to this general assembly, by the petition of Thomas Bailey, late
sheriff and colle6lor of Baltimore county, that from the multiplicity of business in his office,
and other causes, he was unable to complete his collection within the time limitted by law, and as-
certain and make an annual return of insolvencies, so as to be allowed the same by the commission-
ers of the tax for Baltimore county, in consequence of which he is without remedy, unless by the
interference of the general assembly; and the said Thomas Bailey having prayed that a law may
pass, extending to him for a reasonable time, all the powers necessary to collect the balances due
him as sheriff and collector, and to authorise the levy court to levy for him the sum of money which
may appear to be due him, in consequence of payment made by him on the property of insolvents,
as collector; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the said Thomas Bailey be and he
is hereby authorised and empowered, until the first day of January, eighteen hundred and eight, in
as full and ample manner as he could have done during the time limitted by law, to collect all ba-
lances due him as sheriff and collector of Baltimore county for the year eighteen hundred and live,
any law to the contrary notwithstanding.

III. AND BE IT FURTHER ENACTED, That the levy court of Baltimore county be and they are
hereby authorised and directed, at their next annual session for levying taxes on the said county, to
levy for the use of Thomas Bailey such sum as may appear to be due to said Bailey, in consequence
of payments made by him on the property of insolvents, which it appears by certificate from the
clerks of the commissioners of the tax for the city of Baltimore, and Baltimore county, would have
been allowed him for the years eighteen hundred and three and eighteen hundred and four, if the
returns had been made in time.

IV. AND BE IT ENACTED, That it shall be the duty of the said Thomas Bailey, before he pro-
ceeds to execute or distrain the property of any person or persons for taxes or public dues in virtue
this act, to deliver to such person or persons chargeable with the same, at least thirty days pre-
vious to the levying such execution or distress, an account, written in words at full length, of the
taxes demanded of him, her or them, with an affidavit annexed, if required, that he hath not re-
ceived any part thereof, or any thing as security or satisfaction for the same, more than credit given,
to the best of his knowledge.

V. AND BE IT ENACTED, That the said Thomas Bailey, before he derives any benefit from or
under this act, shall lodge a copy of his collection books in the clerk's office of Baltimore county, to
be open for the inspection of ail persons interested in the same.

Books to be
lodged, &c.

An ACT to alter, change and repeal, such parts of the constitu-
tion and form of government of this state as relate to the division
of Saint-Mary's county into electional districts.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants
of Spirit-Mary's county, that they experience great inconvenience for the want of a fourth
