ROBERT BOW IE, ESQUIRE, GOVERNOR. NOVEMBER,

1805.

of said road which passes through Prince-George's county to be opened, cleared and grubbed, in the
manner directed by the said act, and the supplementary act thereto, to the great injury of the inha-
bitants of said county and the public in general; for remedy whereof,

II. BE IT ENACTED, by the General Assembly of Maryland, That William Wilson, Moses Orme and
John Boyd Watkins, or any two of them, shall be and they are hereby appointed commissioners of the
part of said road which has not been opened by the commissioners appointed by the act to which this
is an additional supplement, and the supplementary act thereto, and that they, or any two of them,
he and they are hereby authorised to alter the location of said part of the road, and, when the di-
rection shall be altered, to cause a plot of said road to be made corresponding with such location.

III. AND BE IT ENACTED, That the said commissioners, or any two of them, are hereby autho-
rised and empowered to cause that part of said road not heretofore opened, (after they shall have

established the location of the same, ) to be opened, cleared and grubbed, not exceeding thirty feet
wide, and to cause a plot of that part of the said road which may be opened by them to be recorded
among the records of Prince-George's county; and the said road, when so recorded, shall for ever
thereafter be deemed a public road, and shall be kept in repair as other public roads in said
county.

IV. AND, whereas the part of the said road which passes through Prince-George's county, which
was opened, cleared and grubbed, by the commissioners appointed by the act to which this is an ad-
ditional supplement, is now impassable, owing to the neglect of the said commissioners, BE IT
ENACTED, That the said part of the said road, so opened and cleared as aforesaid, shall be hereaf-
ter considered a public highway, and the levy court of Prince-George's county are hereby directed
to appoint a supervisor of said road, and to assess and levy such sum of money on the assessable
property of said county as will be sufficient to defray the expence of putting the said road in passa-
ble repair, and the said road shall thereafter be kept in repair as other public roads in said county.

V. AND, whereas the sum of one thousand dollars hath been heretofore levied on Prince-George's
county for the purpose of opening the said road, a part of which sum only hath been applied by the
commissioners under the act to which this is an additional supplement, and the supplementary act
thereto, to the use for which it was intended, and a part thereof now remains in the hands of the
said commissioners, or in the hands of the collector who collected the same; therefore, BE IT
ENACTED, That it shall and may be lawful for the commissioners appointed by this act to ask, de-
mand and receive, all sums of money which have been levied and collected in Prince-George's county
for the use of the said road, which remains unexpended, either in the hands of the said commissi-
oners, or either of them, or of the collector who collected the same, and if the same shall not be
paid on demand, the commissioners appointed by this act are hereby directed to cause a suit or suits
to be instituted in the name of the state of Maryland for their use against any of the said commis-
sioners who may have received any part of the money levied as aforesaid, and who have not applied
the same to the opening of the road aforesaid; and the said commissioners hereby appointed may
direct a suit or suits to be instituted against the collector who collected the said money, and his se-
curities, for any sum of money which may remain in his hands, and which shall not be paid to them
on demand.

VI. AND BE IT ENACTED, That it shall be the duty of the commissioners appointed by this act
to pay to the levy court of Prince-George's county, or their order, any sum of money which may
remain in their hands unexpended, after the said part of the said road hereby directed to be opened,
cleared and grubbed, shall have been completed in the manner directed by this act.

VII. AND BE IT ENACTED, That the powers vested in the commissioners appointed by the act
to which this is an additional supplement, and the supplementary act thereto, be and the same are
hereby abrogated and annulled.

VIII. AND BE IT ENACTED, That where any person or persons shall require compensation for
any damages sustained by reason of the road, (to be opened as aforesaid by the commissioners ap-
pointed by this act, ) passing through his, her or their lands, the value of the damages shall be as-
certained, and paid over to the person or persons entitled thereto, in the manner directed by the
fifth section of the act to which this is an additional supplement.

IX. AND BE IT ENACTED, That each commissioner appointed by this act; shall receive two dollars
per diem for every day he may attend in discharging the duties required of him by this act.
