Hamilton for the land sold as aforesaid, and the said Andrew Hamilton hath prayed that a law may
pass, authorising some person to execute a deed, conveying to him in fee-simple the land aforesaid,
upon his paying the purchase money according to the terms of sale; and the prayer thereof appear-
ing reasonable, therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the chief justice of the district for
the time being shall be and he is hereby authorised and empowered to inquire into the circumstances
attending the said sale, and if he shall be of opinion that the same was fairly and properly made,
and the terms thereof complied with on the part of the said Andrew Hamilton, that then the said
chief justice shall execute a deed, conveying to the said Andrew Hamilton all the right, title, claim
and interest, which he the said John Hamilton had in the tract of land called Hamilton's Purchase,
at the time of the sale aforesaid, and the said deed, when recorded among the land records of Prince-
George's county, shall have the same effect and operation as if the said deed had been executed by
the said Thomas Macgill in his life-time; provided, that nothing in this act contained shall affect or
impair the right of any other person or persons fairly acquired before the passage of this act.

An ACT authorising a lottery to raise a sum of money to purchase
a fire engine, and to purchase ground and build a school-house, in
Rockville, in Montgomery county.

BE IT ENACTED, by the General Assembly of Maryland, That Upton Beall, Honore Martin, Lewis
Beall, Thomas Linsted and Thomas P. Wilson, or a majority of them, be and they are hereby
authorised to propose a scheme of lottery for raising a sum of money, not exceeding two thousand five
hundred dollars, and to sell and dispose of the tickets thereof; provided, that the said Upton Beall,
Honore Martin, Lewis Beall, Thomas Linsted and Thomas P. Wilson, or a majority of them, be-
fore they proceed to the sale of any ticket or tickets in said lottery, shall give bond to the state of
Maryland, in the penalty of five thousand dollars, conditioned, that they will well and truly apply
the monies arising therefrom, within ninety days after the drawing thereof, to the payment of the
prizes drawn therein to the adventurers to whom they shall be due, and after deducting the neces-
sary expences incurred in the management thereof, shall apply the residue, within twenty months,
to the purchase of a fire engine, and the purchasing ground in the said town, or the precincts there-
of, and building a school-house thereon.

II. AND BE IT ENACTED, That the said bond shall be lodged in the clerk's office of Montgomery
county, to be there recorded, and upon such bond, or any office copy thereof, suit or suits may be
instituted for any breach or noncompliance with the condition thereof.
CHAP. LXX.

An ACT to authorise a lottery in Frederick-town, in Frederick
county.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants
of Frederick-town, in Frederick county, that the Sun fire engine belonging to said town, as
also other engines in said town, can, by reason of their limitted operations, be of little or no use
to extinguish fire in or prevent from communicating to three story or other high buildings, and
have prayed that an act may pass authorising the Sun fire company of Frederick-town, in Frederick
county, to raise by lottery a sum of money for the purpose of purchasing a more adequate engine,
for the better security of the inhabitants of the said town; and the same being considered reason-
able and proper, therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That Henry Steiner, Francis Mantz,
Henry Bantz, George Creager, senior, Lewis Wiltzshimer, Charles Schell, Jacob Medtard, George
Adam Ebert and Peter Burkhart, or a majority of them, be and they are hereby authorised to pro-
pose a scheme of a lottery, for raising the sum of eight hundred and seventy-five dollars for the pur-
pose aforesaid, and to sell and dispose of the tickets therein.

III. AND BE IT ENACTED, That the said Henry Steiner, Francis Mantz, Henry Bantz, George
Creager, senior, Lewis Wiltzshimer, Charles Schell, Jacob Medtard, George Adam Ebert and Pe-
ter Burkhart, before they proceed to the sale of any ticket or tickets in said lottery, shall give and
execute a bond to the state of Maryland, in the penalty of seventeen hundred and fifty dollars, con-
ditioned, that they will well and truly apply the monies arising therefrom, within three months af-
