978 LAWS OF MARYLAND [CH. 516

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That Section 16 of Article 31B of the Annotated
Code of Maryland (1951 Edition), title "Defective Delin-
quents", sub-title "Application", be and it is hereby re-
pealed and re-enacted, with amendments, and that Section
3 of Chapter 476 of the Acts of 1951, said section having
been amended by Chapter 65 of the Acts of 1952, be and
it is hereby repealed and re-enacted, with amendments,
and all to read as follows:

16. (Article Construed Prospectively. ) Nothing in this
Article shall be construed to extend to or to affect any per-
son who on June 1, [1952] 1954, is held as an inmate or
prisoner of any penal institution operated and supervised
by the Department of Correction in this State, unless after
that time he is convicted and sentenced in a court of this
State for a crime or offense listed in Section 6 above; and
it is specifically provided that one such offense or crime
committed after June 1, [1952J 1954, if followed by con-
viction and sentence, shall be sufficient to bring the said
person within the application of this Article. Any person
who is held as an inmate or prisoner in any such penal in-
stitution on June 1, [1952] 1954, and who is adjudged to
have broken the terms of any parole or probation on which
he is subsequently released shall be subject to the provi-
sions of this Article as if he had committed a new and
separate crime or offense as listed above in Section 6, if
the offense for which he was originally convicted was with-
in one of the categories of said Section 6. Nothing in this
Article shall be construed to bring any person within the
application of this Article by reason of any crime or offense
committed prior to June 1, [1952, ] 1954, unless it is under
the foregoing provisions of this section.

3. This Act shall take effect on June 1, 1954, except that
the Chief Psychiatrist and the two associate psychiatrists
of the Department of Correction shall be appointed as soon
as possible after July 1, [1952, ] 1953 at the salaries pro-
vided for hereinabove in this Act.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1953.
