new Council at the first meeting succeeding each biennial
election as herein provided. The Mayor shall preside at
meetings of the Council and shall exercise such other
powers and perform such other duties as are or may be
conferred and imposed upon him by this charter and the
ordinances of the Town. He shall be recognized as the
head of the Town government for all ceremonial purposes,
by the Courts for serving civil process, and by the Gov-
ernor for the purpose of military law. If a vacancy occurs
in the office of Mayor, or in case of his absence or dis-
ability, the Mayor pro tem shall act as Mayor for the
unexpired term or during the continuance of the absence
or disability. If any councilman appointed by this charter,
or hereafter elected, shall die or remove from the State
of Maryland during his term of office, said office shall be
declared to be vacant, and it shall be filled by the Mayor
and Council for the unexpired term.

The Mayor and Council hereby constituted, and their
successors shall appoint immediately after their election
of a Mayor and Mayor pro tem as above provided, at the
first meeting of the said Mayor and Council, a Treasurer,
Clerk, Engineer, and such other officers as they may deter-
mine from time to time to be necessary to carry on the
government of the Town, and such Treasurer, Clerk, Engi-
neer, or other officer shall file such bond as may be
required by the Mayor and Council to guarantee the faith-
ful performance of his duties.

Every officer and councilman, exclusive of the Mayor,
of the Town, shall before entering upon the duties of his
office, take and subscribe to the following oath or affirma-
tion, to be made before the Mayor, a signed copy to be
filed and kept in the office of the Town Clerk:

"I.................................................. swear, (or affirm) that I will sup-
port the Constitution of the United States, and that I will
be faithful and bear true allegiance to the State of Mary-
land and support the Constitution and laws thereof; and
that I will, without partiality or prejudice, execute the
office of................................................. according to the Constitution

and laws of this State. "

The Mayor shall take the same oath before the Clerk
of the Circuit Court for Prince George's County, Maryland,
or before one of his sworn deputies.

SEC. 4. And be it further enacted, That each elective
officer of said Town, and the Treasurer appointed by the
Mayor and Council, shall be a freeholder, or the spouse
of a freeholder, shall have attained the age of at least
