that the Treasurer of the Town of Forest Heights in
Prince George's County shall be appointed by the Mayor
and Town Council and providing for a referendum
thereon.

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That Sections 5, 6 and 13 of Chapter 142 of the
Acts of 1949 be and they are hereby repealed and re-
enacted, with amendments, to read as follows:

5. (a) The Mayor shall be elected for a term of two
years. Two of said Councilmen shall be elected from each
of the three wards of which the town is composed, and each
councilman shall be elected for a term of two years, except
that at the first election to be held hereunder, one council-
man from each of said wards shall be elected for a period of
one year, and in the event of any vacancy occurring during
the term of office of any Councilman or the Mayor, the
election shall be for the unexpired term. A Treasurer shall
be [elected] appointed by the Mayor and Town Council
from the town at large [and shall be elected] for a term of
two years. The Mayor [, Treasurer,] and Councilmen
shall hold their respective offices for the several terms
aforesaid and until their successors shall have been duly
elected and qualified, unless otherwise terminated by opera-
tion of law. Each Councilman shall be elected by the voters
of his respective ward. On the second Wednesday in May
of each year, regular annual elections shall be held for the
election of a Mayor [, Treasurer,] and Councilmen as their
respective terms of office expire.

(b) No person shall be eligible as Mayor, [Treasurer,] or
Councilman unless upon the day of election he shall have
been an actual bona fide resident of the Town of Forest
Heights for a period of at least one year prior to the day
of election, and in the case of Councilmen, resident of the
ward from which they shall be elected for at least one year
prior to the day of election.

(c) Neither the Mayor nor any of the Councilmen shall
hold any other office under the corporation during their
respective terms of off ice, neither shall they nor any other
officer of the corporation, either directly or indirectly
through the medium or agency of other persons, enter into
any contract or contracts with the corporation.

6. The Treasurer to be [elected] appointed as above
provided shall make all collections of taxes and receive all
money paid for the use and benefit of said corporation; he
