ized to be acquired by this Act shall be conveyed to the
United States until the State Roads Commission is assured
that the parkway, including a traffic-way for passenger
vehicles, will be built on lands so conveyed. Upon the
acquisition of said properties, interests, easements, or
rights-of-way, the State Roads Commission is authorized
to convey, from time to time, the right, title and interest
therein held by the State Roads Commission for the use
of the State of Maryland to the United States.

The State of Maryland or any Department, Commission,
or Agency thereof, with the approval of the Board of
Public Works, and any County, Municipal Corporation,
or other political sub-division thereof is hereby authorized
to transfer direct to the United States, without cost, any
land, interest in land, rights-of-way over land, scenic or
other easements, which are necessary to be acquired as
additions to the parkway lands along the Chesapeake and
Ohio Canal; and it or they are further authorized to
accept such land or interest in land in excess to that
which is necessary as additions to the parkway lands along
the Chesapeake and Ohio Canal when proffered by the
Secretary of the Interior.

PROVIDED, HOWEVER, THAT THE STATE ROADS
COMMISSION SHALL NOT PURCHASE WITH ANY
FUNDS NOW OR HEREAFTER PROVIDED FOR
SUCH PURPOSE, ANY LANDS, RIGHTS, TITLE OR
INTEREST IN LANDS, RIGHTS-OF-WAYS, SCENIC
OR OTHER EASEMENTS IN LANDS OR ANY ADDI-
TION TO OR EXTENSION OF SAID PARKWAY
OTHER THAN FOR AN ADDITION OR EXTENSION
BETWEEN THE TOWN OF HANCOCK AND THE
CITY OF CUMBERLAND, BOTH IN MARYLAND,
UNLESS SO AUTHORIZED BY A SUBSEQUENT EN-
ACTMENT OF THE GENERAL ASSEMBLY OF MARY-
LAND; THERE SHALL BE AN INTERSECTION OF
THE SAID PARKWAY, WITH U. S. ROUTE NO. 40
EITHER IN OR WESTERLY FROM THE TOWN OF
HANCOCK; AND THE PROVISIONS OF THIS ACT
SHALL NOT BE DEEMED TO BE REPEALED OR
MODIFIED BY ANY SUCH SUBSEQUENT ENACT-
MENT UNLESS SPECIFICALLY REFERRED TO
THEREIN.

PROVIDED, FURTHER, THAT THE STATE ROADS
COMMISSION SHALL NOT PROCEED WITH OR AT-
TEMPT TO EXERCISE ANY OF THE POWERS CON-
TAINED IN THIS ACT UNLESS AND UNTIL THE
