certain land or interests in land for the purpose of
increasing the present parkway width of the Chesapeake
and Ohio Canal lands between Hancock and Cumber-
land, Maryland, in accordance with Public Law No. 811
of the 81st Congress.
WHEREAS, the Congress of the United States has enacted
basic legislation authorizing the construction and develop-
ment of a parkway along the line of the Chesapeake and
Ohio Canal in Maryland; and
WHEREAS, the present width of the existing parkway
lands owned by the United States are inadequate for the
proper and complete development covering all phases of
recreational activities, including a traffic-way for passen-
ger vehicles; and
WHEREAS, the Congress and duly designated Federal
Agencies have determined that it is both feasible and
desirable to construct and maintain a parkway along said
route, including a modern traffic-way for passenger vehi-
cular traffic, provided the State of Maryland, or the proper
agency thereof, shall acquire and convey to the United
States the additional lands necessary to adequately develop
the parkway; and
WHEREAS, it is considered desirable and beneficial in
the public interest that the United States develop and
maintain such a parkway; now, therefore,
SECTION 1. Be it enacted by the General Assembly of Maryland,
That the State Roads Commission, in cooperation with
the United States Department of the Interior, may acquire
by gift, purchase, condemnation, or otherwise, in its dis-
cretion, in the name of the State Roads Commission for the
use of the State of Maryland, out of any funds which may
be set aside for such purposes, or out of any unused funds
in its hands, NOT EXCEEDING THE SUM OF THREE
HUNDRED AND FIFTY THOUSAND DOLLARS
($350, 000. ) the land, interest in land, rights-of-way over
land, scenic or other easements and other rights in land,
which are necessary to be acquired as additions to the park-
way lands along the Chesapeake and Ohio Canal between
Hancock and Cumberland, Maryland, in order to increase
the present parkway width to an average of one hundred
(100) acres per mile for the entire length of the park-
way between Hancock and Cumberland, as authorized by
the Act of Congress approved September 22, 1950 (Public
Law 811, 81st Cong. ). Provided, however, no land author-
