SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sub-section (a) of Section 44 of Article
2B of the Annotated Code of Maryland (1951 Edition),
title "Alcoholic Beverages", sub-title "General Provision
on Issue of Licenses", be and it is hereby repealed and re-
enacted, with amendments, and that a new sub-section be
and it is hereby added to said section, said new sub-section
to be known as Sub-section (c), to follow immediately after
Sub-section (b) of said section, and to read as follows:
44. (Anne Arundel County. ) (a) In Anne Arundel
County no new license shall be granted to sell alcoholic
beverages in any building located with one thousand (1000)
feet of the grounds of a church or school, but the license
of any person now holding a license for any building located
within such distance of the grounds of a church or school
may be renewed or extended for the same building. This
section does not apply to the City of Annapolis. This sec-
tion shall not apply to any transfer or assignment of a
license located within such distance nor shall this section
apply to the issuance of a license for a place of business
established for the sale of alcoholic beverages prior to
June 1, 1939. [Provided, however, that this section shall
not apply to Class LP, Off Sale, Package Goods, license. ]
PROVIDED, HOWEVER, THAT AFTER JANUARY 1,
1954, THIS SECTION SHALL APPLY TO CLASS LP,
OFF SALE, PACKAGE GOODS, LICENSES.
(c) In Anne Arundel County the Board of License Com-
missioners shall not approve any license for an establish-
ment if an application for a license to sell alcoholic bever-
ages for said establishment has been refused within one
year immediately previous.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1953.
