Board. Said County Roads Board shall enter upon its
duties and assume the responsibilities and powers herein
and hereinafter conferred when, but not until, the effective
date of the taking over of the roads in Wicomico County by
the County Commissioners of Wicomico County from the
State Roads Commission of Maryland pursuant to the pro-
visions of Article 89B, Section 173 of the 1951 Code of
Public General Laws of Maryland.
235. The County Commissioners of Wicomico County
shall have control over the public roads, bridges, drains,
water courses, public landings, culverts, ferries and curbs
and gutters along the same in Wicomico County, subject
only to existing rights and duties of the State Roads Com-
mission of Maryland until Wicomico County takes over the
construction, reconstruction and maintenance of its County
Roads pursuant to Article 89B, Section 173 of the Code of
Public General Laws of Maryland (1951 Edition), and
thereafter the said County Roads Board for Wicomico
County shall have control and shall regulate them.
236. The County Commissioners of Wicomico County
are authorized, empowered and directed at the time of mak-
ing their annual levy to levy such amount annually as in
their opinion shall be necessary for the building, repairing,
reconstructing, maintenance and regulation of the use of
the public roads, bridges, drains, water courses, public
landings, culverts, ferries and curbs and gutters along
same in Wicomico County, and for the purchase and main-
tenance of equipment and for the purchase or rental of land
or buildings to be used for that purpose. The monies so
levied shall simply be designated "For construction, re-
construction and maintenance of County roads, bridges,
drains, water courses, public landings, culverts, ferries,
curbs and gutters, and purchasing and renting of equip-
ment, land and buildings in connection therewith", but no
part thereof shall be earmarked by said County Commis-
sioners for specific purposes, all such authority to so ear-
mark being vested in said County Roads Board. All monies
so levied and received shall be deposited by the County
Treasurer in a special fund for that purpose and paid out of
that fund by the County Treasurer on requisition of said
County Roads Board. Any unexpended surplus remaining
in said account at the end of any year may be carried over
and used by said County Roads Board in future years to
carry out the purposes of this sub-title or may be used on
account of the costs of the next year's roads program.
