to be constructed, or require the owner or owners to recon-
struct the same, out of such material as the Board of Com-
missioners may designate; and in case the parties owning
the property fronting on such sidewalk shall refuse to have
such sidewalks, gutters or curbing made and constructed
when directed to do so by any ordinance, or shall refuse to
change the grade or reconstruct when directed by any ordi-
ance, the said Board of Commissioners shall have the
work done and material found, and shall cause the propor-
tion of expenses chargeable to each proprietor to be ascer-
tained, and may recover the same by action in the Circuit
Court or before a trial magistrate, according to the amount
awarded or may distrain the personal property of such
proprietor at any time within six months from the time
when the ascertainment of the proportion of such proprietor
shall be made; provided at least two days' notice be given
by said Board of Commissioners to the said proprietor of
the amount of his or her assessment prior to such suit or
distress, and the said corporation is hereby vested with full
power to pass all ordinances necessary to carry this section
into effect.
764V. (a) The agreement between the Commissioners of
Thurmont and The Citizens' Electric Light and Power Com-
pany of Thurmont, a body corporate, is hereby ratified and
confirmed, and the said, The Town of Thurmont, said mu-
nicipal body corporate, is hereby granted full power and
authority to own, operate and maintain the electric light
and power plant erected by the said The Citizens' Electric
Light and Power Company of Thurmont, and to make all
such contracts as may be necessary to light streets, lanes,
alleys and public buildings of said Town of Thurmont and
furnish light and power to its citizens.
(b) The municipal corporation, The Town of Thurmont,
is authorized and empowered to own in its name, for the
benefit of said municipal corporation and to acquire said
real estate either by gift or donation for the purpose of
creating and maintaining a Memorial Park, dedicated to
those residents of the Thurmont District, who gave their
services to the Nation during the World War; and when
said real estate has been so acquired by said municipal
corporation that the said real estate is to be deeded to said
municipal corporation in fee.
THE MAYOR
765 Term. The mayor shall be elected as hereinafter pro-
vided and shall hold office for a term of two (2) years and
