a misdemeanor, and upon conviction thereof in any court
of competent jurisdiction, or before any justice of the
peace of this State, shall be punished by fine of not less than
Five Dollars nor more than Five Hundred Dollars or im-
prisonment in the county jail, or in the house of correction,
for not less than thirty days nor more than two years, or
by both such fine and imprisonment in the discretion of said
justice or court, according to the gravity of the offense.
Nothing in this section shall be construed to prohibit the
removal of any THE REMAINS OF ANY HUMAN BODY,
monument, gravestone or other marker from an abandoned
cemetery of such THE REMAINS OF ANY HUMAN
BONDY BODY, monument, gravestone or other marker is
placed in an accessible place in a permanent cemetery-;
PROVIDED, HOWEVER, THAT THE STATE'S ATTOR-
NEYS OF THE SEVERAL COUNTIES OR BALTIMORE
CITY SHALL FIRST GIVE HIS PERMISSION FOR
SUCH A REMOVAL IN WRITING. Any justice of the
peace in this State, except civil justices in the City of
Baltimore, shall have jurisdiction under this section.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1953.

(House Bill 366)
AN ACT to repeal and re-enact, with amendments, Sec-
tion 409 of the Charter and Public Local Laws of Balti-
more City (1949 Edition), being Article 4 of the Code of
Public Local Laws of Maryland, title "Baltimore City",
sub-title "Justices of the Peace and Constables", pro-
viding that any person arrested and charged with "man-
slaughter by automobile, motor vehicle, motor boat, loco-
motive, engine, car, street car, train or other vehicles"
may be released by the Police Captain, Lieutenant or
other officer on duty and in charge of the station-house
upon deposit of an amount equal to the fine imposed if
found guilty.
