375D. The provisions of this sub-title shall not apply
to sales of dangerous drugs made to registered practi-
tioners of pharmacy, medicine, dentistry, or veterinary
medicine, or to sales made by any manufacturer, whole-
sale druggist, or licensed pharmacist to another manu-
facturer, wholesale druggist, or licensed pharmacist or to
a hospital or institution operating a dispensary in which a
practitioner licensed by law to administer dangerous drugs
is in charge, providing records of such sales are main-
tained, and available for inspection, showing date of sale,
name and address of purchaser, and quantity purchased.
375E. The provisions of this sub-title shall apply to
the sale by any manufacturer, wholesale druggist, retail
(pharmacist, or jobber of dangerous drugs, to any person,
firm, corporation, association other than those legally
qualified and authorized to purchase and hold same for
use or re-sale, and to any practitioner's assistant who is
not legally licensed to administer dangerous drugs.
375F. The State Department of Health is hereby
authorized to promulgate necessary regulations and inter-
pretations, not inconsistent with law, for the administra-
tion and enforcement of this Act.
375G. Any person, firm or corporation who violates
any of the provisions of this sub-title, or refuses, neglects
or fails to comply with the provisions and requirements
hereof, or fails to comply with the provisions and require-
ments hereof, shall be deemed guilty of a misdemeanor and
upon conviction thereof shall, for the first offense, be fined
not more than $250. 00, for the second, or subsequent
offense not more than $500. 00.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1953.
